1. Introduction

These Terms of Service ("Terms") govern your use of the HonestyBox website at honestybox.app (the "Site") and the HonestyBox platform and services (the "Service"). The Service is operated by HonestyBox ("we," "us," "our").

By accessing the Site or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Service.

2. What HonestyBox is

HonestyBox is a contactless payment platform that allows businesses and individuals to accept payments via QR codes powered by Stripe. Typical use cases include honesty boxes, farm stalls, car parks, campsites, holiday lets, and other self-service or unattended payment scenarios.

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By registering for an account, you confirm that the information you provide is accurate and complete.

4. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate your account if we reasonably believe you have breached these Terms.

5. Payment processing

HonestyBox uses Stripe to process payments. By using the Service, you agree to be bound by Stripe's terms of service (https://stripe.com/legal) in addition to these Terms.

We are not a payment processor. We provide the technology that connects your QR codes to Stripe's payment infrastructure. All funds are processed and held by Stripe and paid out to your connected Stripe account in accordance with Stripe's payout schedule.

We are not responsible for any failures, delays, or errors in payment processing caused by Stripe, your bank, or your customer's payment provider.

6. Fees

Our current pricing is displayed on the Site. We reserve the right to change our fees at any time, but we will give you reasonable notice of any changes before they take effect. Continued use of the Service after a fee change constitutes acceptance of the new fees.

Stripe's own transaction fees apply in addition to any HonestyBox fees and are determined by Stripe.

7. Your responsibilities

When using the Service, you agree to:

• Use the Service only for lawful purposes and in accordance with all applicable laws and regulations
• Not use the Service to accept payments for illegal goods, services, or activities
• Ensure that any pricing, descriptions, or information you display alongside your QR codes is accurate and not misleading
• Comply with all applicable consumer protection, trading standards, and tax obligations relevant to your business
• Handle any customer disputes, refunds, or complaints relating to the goods or services you sell

8. Intellectual property

All content on the Site, including text, graphics, logos, and software, is the property of Digital Bake or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

You retain ownership of any content, branding, or images you upload to the Service.

9. Limitation of liability

To the fullest extent permitted by law:

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
• We do not guarantee that the Service will be uninterrupted, error-free, or secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability to you for any claim arising from these Terms or the Service shall not exceed the total fees you have paid to us in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10. Indemnification

You agree to indemnify and hold harmless Digital Bake, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or the rights of a third party.

11. Termination

You may stop using the Service and close your account at any time.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Any outstanding fees owed to us remain payable.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Site. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
